1. Agreement and provider
These Terms of Use ("Terms") are an agreement between you and Individual Entrepreneur Danylo Klymov (Ukrainian: Фізична особа-підприємець Климов Данило Віталійович), registered at 45 Yuvileinyi Avenue, Apartment 129, Zaporizhzhia, Zaporizhzhia Oblast, 69097, Ukraine ("OnlyKeep", "we", "us", or "our"). They govern your use of the OnlyKeep iOS application.
By downloading, purchasing, or using OnlyKeep, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app. If you downloaded OnlyKeep through the App Store, Apple's Standard Licensed Application End User License Agreement also applies. These Terms add app-specific rules and do not reduce rights granted by applicable consumer law.
2. Eligibility and minors
OnlyKeep is not directed to children under 13. You must be at least 13 to use the app. If you are under the legal age of majority where you live, a parent or legal guardian must review and agree to these Terms and authorize any purchase. You must also meet the minimum age and account requirements established by Apple for your region.
3. License
OnlyKeep is licensed, not sold. Subject to these Terms, the Apple Media Services Terms and Apple's Usage Rules, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use OnlyKeep on Apple-branded devices you own or control. Family Sharing or volume purchasing may apply where Apple permits it.
We and our licensors retain all rights not expressly granted. You may not copy, distribute, rent, lease, sell, sublicense, modify, create derivative works from, interfere with, or reverse engineer the app except where applicable law or an open-source license expressly permits it.
4. What OnlyKeep does
OnlyKeep helps you review media in your Apple Photos library, mark items to keep or consider deleting, find likely duplicates or similar items, and organize cleanup sessions by time, media type, or location metadata.
OnlyKeep is not a backup, recovery, cloud-storage, antivirus, or guaranteed duplicate-detection service. Duplicate confidence, file size, storage savings, location names, counts, and other results may be estimates. Results can depend on Photos permission, Limited Photos access, iCloud availability, network connectivity, device performance, operating-system behavior, and the condition of your library.
5. Your media and deletion responsibility
You retain all rights in your photos and videos. OnlyKeep does not claim ownership of them.
A swipe or selection only creates a local cleanup decision. Actual deletion is requested through Apple PhotoKit only after you review the selected items and confirm the iOS system dialog. You are responsible for checking each selected item and maintaining separate backups of important media before confirming deletion. Depending on iOS and your settings, deleted items may remain temporarily recoverable in the Photos "Recently Deleted" album.
To the maximum extent permitted by law, we are not responsible for deletion you authorize, failure to maintain a backup, or inability to recover media after the applicable recovery period. Nothing in these Terms excludes liability that cannot lawfully be excluded.
6. Free access and Pro features
OnlyKeep may offer a free allowance, limited cleanup sessions, promotional access, subscriptions, or a one-time Lifetime purchase. Current limits and included features are shown in the app and may vary by version, territory, or genuine experiment. We will not remove access to a completed purchase contrary to applicable law or Apple's rules.
Free-use counters and trial-session records may be stored locally and in the iOS Keychain to administer limits and prevent repeated resets. Attempts to manipulate purchase status, usage counters, receipts, or entitlement checks may result in loss of promotional or free access.
7. Subscriptions
Monthly and yearly plans are auto-renewable subscriptions. Before purchase, the paywall displays the plan, billing period, localized price, and included access. Payment is charged by Apple to your Apple Account after confirmation.
Unless you cancel, a subscription renews automatically for the same period at the price shown by Apple, subject to any legally required notice or consent for a price change. You can manage or cancel a subscription in your Apple Account subscription settings. Cancellation takes effect at the end of the current paid period; deleting OnlyKeep does not cancel a subscription.
If Apple offers a free trial or introductory price, the eligibility, length, conversion price, and other conditions shown by Apple at purchase apply. Any unused portion is handled according to Apple's rules and applicable law.
8. Lifetime purchase
Lifetime is a one-time, non-renewing in-app purchase that unlocks the then-current OnlyKeep Pro entitlement for as long as we continue to make OnlyKeep available and technically support that entitlement. "Lifetime" refers to the supported lifetime of the OnlyKeep product, not the lifetime of any person, device, Apple Account, or company, and does not promise that the app, every feature, or compatibility with future operating systems will exist forever.
A Lifetime purchase does not include a different future product or a service expressly sold separately unless we state otherwise. Mandatory consumer rights remain unaffected.
9. Purchase restoration and refunds
Use "Restore Purchases" in the app to request restoration of eligible purchases associated with your Apple Account. Restoration depends on Apple's and RevenueCat's receipt and entitlement services.
Apple processes App Store payments and refunds. We cannot directly issue an App Store refund. You can request one through Apple's refund service or Apple Support. Refund eligibility is determined by Apple and applicable law.
10. Privacy and permissions
Our Privacy Policy explains how information is handled. Photos permission is required for core cleanup features. Notifications, optional analytics, and optional crash reporting can be declined or disabled. Certain necessary services, including purchase validation and app-configuration checks, still operate as described in the Privacy Policy.
11. Acceptable use
You agree not to:
- use OnlyKeep unlawfully or to infringe another person's rights;
- disrupt, overload, bypass, probe, or compromise the app, purchase systems, providers, or security controls;
- falsify receipts, entitlement status, or free-use records;
- use automated means to extract or exploit the app except as allowed by law;
- remove proprietary notices or use our branding without permission;
- upload unlawful or unnecessary sensitive content in a support request.
12. Third-party services
OnlyKeep relies on Apple services and may use Firebase, Mixpanel, and RevenueCat as described in the Privacy Policy. Your use of Apple devices, iCloud Photos, the App Store, payment services, network service, and other third-party services is also governed by their terms. We are not responsible for a third-party service outside our reasonable control.
Open-source components remain governed by their respective licenses, available under Open Source Licenses in OnlyKeep Settings.
13. Updates, availability, and termination
We may add, change, suspend, or discontinue features to improve the app, respond to security or legal requirements, address third-party changes, or maintain commercial viability. We may require an update where an older version is unsafe, incompatible, or no longer supported. We do not guarantee uninterrupted or error-free operation.
You may stop using OnlyKeep at any time. We may suspend access to online components or terminate this license if you materially violate these Terms, subject to required notice and applicable law. Sections that by nature should survive termination, including intellectual property, disclaimers, liability, disputes, and Apple-specific terms, will survive.
14. Warranty disclaimer
OnlyKeep is provided "as is" and "as available" to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability where such disclaimers are lawful.
If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by Apple's terms. To the maximum extent permitted by law, Apple has no other warranty obligation regarding OnlyKeep. We remain responsible for any other non-excludable warranty obligation applicable to us.
15. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, loss of opportunity, or device or service interruption arising from OnlyKeep. Our total aggregate liability relating to the app will not exceed the greater of the amount you paid for OnlyKeep during the 12 months before the event giving rise to the claim or USD 50.
These limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, violation of mandatory privacy or consumer rights, or any liability that cannot be limited under applicable law. Some jurisdictions do not permit particular exclusions, so part of this section may not apply to you.
16. Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws rules. Before filing a claim, please contact support@klymov.dev so we can try to resolve it informally.
If you are a consumer, this choice does not deprive you of mandatory protections granted by the law of your country of residence, and you may bring a claim in any court available to you under mandatory consumer law. Otherwise, disputes are subject to the competent courts of Ukraine.
17. Changes to these Terms
We may update these Terms to reflect changes to the app, purchases, providers, or law. We will update the date above and provide appropriate notice of material changes. Changes apply prospectively. If you do not agree to an update, stop using the app and cancel any subscription before its next renewal.
18. Apple-specific terms
You acknowledge that these Terms are between you and us, not Apple. We, not Apple, are responsible for OnlyKeep, maintenance and support, and addressing claims relating to the app, including product-liability, regulatory, privacy, consumer-protection, and intellectual-property claims. Apple has no obligation to provide maintenance or support.
You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism and are not listed on a United States government prohibited or restricted-party list. You must comply with applicable third-party terms when using the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you upon your acceptance.
